I bought a preamp from this site. seller shipped. it arrived damaged and I immediately texted the seller and sent pics and then called and discussed. he said he would file a claim the following Monday. Which the following monday FED EX picked up the box with the damaged item in it.

so now its been a week and a day and I have no item and no refund. when I asked him his plan he said he would take are of it and was waiting for fed ex, well its been a week in fed ex hands. I told him I wasnt feeling like I shoould be waiting as i am not involved in the matter any more , he told me to have patience.

what is the feeling on this situation?

IMHO, once the seller received the unit back and verified it's condition, the seller should have refunded your money. That's always the way I have done it.

However, if the seller doesn't have the money, (many of us have already bought or are buying a new piece of gear when we sell something), he might not have the funds until the carrier pays for the damage. This is NOT the way to do it, but if the seller really doesn't have the money, what can he do.

Ime Fedex takes much longer investigating and settling damage claims than UPS or USPS. They'll also do everything in their power to deny the claim and put the blame on the seller for inadequate and/or poor packaging.

I sell quite a bit. It is incumbent on the seller to get the gear to the buyer in the condition described in the ad. Failure to do so should result in an immediate refund. You have been more than patient and the seller has no reason to be holding your money.

To protect yourself, if you have paid by PayPal or by credit card open a dispute immediately to get it on the record. Both will usually reverse the transaction fairly quickly after you have shown them the pictures of the damage and the relevant emails.

I understand that sometimes we spend the funds not expecting this to happen. however the guy is just ignoring me now and he is also selling some things on here.

I think communication makes a huge difference. and the guy is ignoring me. its really not in my hands anymore. so I dont think I should be waiting around on him now. it would be different if I had the item still and was waiting on fed ex.

Do you want to complain about it or do you want to solve the problem? What was your method of payment? If it is credit card or PayPal you have recourse per my post above.

If it is another form of payment you still have recourse to open a dispute on this site. Go to the main U.S. Audiomart page and at the bottom of the page is a button that says "contact us". Select the button and there will be a drop down box, select your problem and send a message to get the site administrators involved.

He's ignoring you because he's hoping that FedEx will pay off the claim soon and then he won't have to dig into his pockets to refund your money, which in his mind is now his money.

If he's completely shut down all lines of communication because he doesn't want to deal with you while he waits, then he's a douchebag. Needless to say....don't ever buy anything else from him again. Communication is always a key factor in every transaction, and especially crucial in transactions when problems arise.

I did do something. Paypal was involved. you think I just sat down with my thumb and did nothing? my question and reason for asking here is because he is selling things right now.

He paid last night. never has spoken to me but he has paid so I guess I will let it ride.

I think it should be noted in feedback that he didnt communicate at all after fed ex picked up the package.

The OP also has the option of leaving no feedback, or a neutral feedback.

However the facts are that the seller agreed to a refund, made the claim and the money was in the buyer's hands two weeks after the damaged item was received. (If I understand the timing correctly from this thread.)

That's really not so bad. CAM Staff have had to deal with a lot worse, and I have personal experience with a UPS claim that took 3 months to be evaluated and another 2 months to be paid.
